Trivia Game Subscription Service Rules and regulations
1. The "Trivia Game Subscription Service" is
provided by TMG.
2. No purchase necessary.
3. The contest begins on December 1st, 2006 at 12:01 a.m.
Eastern Time ("ET") and ends on December 31st, 2010 at 11:59 p.m. ET ("Contest
Period"). Each round of the contest starts on the first day of each month
during the Contest Period at 12:01 a.m. and ends on the last day of that month
at 11:59p.m. ET. ("Round"). For greater clarity, the last day of the last Round
in the Contest will be December 31st, 2010.
4. These Rules and Regulations are applicable on all
services provided by TMG.
5. The Trivia Game Subscription Service is open to all residents of Canada
(except residents of Quebec) who are over the age of 16 at the time of
entry except employees (and those with whom such employees are
domiciled) of TMG (the Sponsor), their advertising and promotion
agencies and the contest judges. Residents of the province of
Quebec who chose to participate in this service will not be eligible or
considered for the prize. No compensation for any charges incurred by
our services will be issued for Residents of the province of Quebec.
6. To enter the Trivia Game Subscription Service by text
message, send a SMS message to 84040 including the answer to the question you
see on the television advertisement. Your entry must be received within the
Contest Period. Entries will be rejected if entry is not fully completed and
submitted during the Contest Period. Your first message is free.
7. The cost of receiving a question from the Trivia Game
Subscription Service is CAD $2.00, including GST.
8. The Trivia Game Subscription Service consists of (16)
sixteen questions per month (i.e. (4) four questions per week) which will be
text messaged to your mobile telephone. You will receive one chance to win a
prize for each question you answer correctly within the prescribed time limit
(if any).
9. To obtain an entry
without purchase send a 100 or more word hand written original essay on "Why you love trivia games" and include your name, address, mobile phone number
and/or email address, in a separate envelope with sufficient postage to: TMG, P.O. Box 93, 119 Spadina Ave. Toronto, ON. M5T 2T3. You must indicate the exact name of the
contest which you are entering on the top of the essay entry form. No purchase
entries must be received before the end of the Round. Maximum of eight (8) no purchase entries
per person per month.
10. On the day after the close of the each Round at
approximately 12:00 p.m. ET in Toronto
an eligible entrant will be selected by random draw from all eligible entries
received since the last draw. The last draw will take place on January 1st, 2011 at approximately 12:00 p.m. E.T. The entrant selected will be eligible to win a
prize, as described below. The odds of winning depend on the number of eligible
entries received during that Round.
11. Before being declared a winner, each selected entrant
must first a) correctly answer, unaided, a time-limited mathematical skill
testing question to be administered by telephone at a prearranged mutually
convenient time, by email or by text
message and; b) sign (or if a minor in their Province or territory of
residence, have his/her parent or legal guardian sign) a standard declaration
and release form confirming compliance with the contest rules, acceptance of
the prize as awarded and releasing the Sponsor, its advertising and promotion
agencies, the contest judges and their respective officers, directors, agents,
representatives, successors and assigns (the "Releasees") from any liability in
connection with this contest, the entrant's participation therein and/or the
awarding and use of the prize or any portion thereof. If a selected entrant cannot be contacted by
sms text message, email or telephone or fails to return the contest documents
within the specified time, he/she will forfeit the prize and an alternate
eligible entrant may be selected. A total of (13) thirteen Round Prizes per year, as
defined herein, may be won during the Contest Period. At the end of each Round (1)
one Round Prize is available to be won each consisting of an Apple iMac (CDN$1,299.99).
12. Prizes must be accepted as awarded and are not transferable
or convertible to cash. No substitutions
except at Sponsor's option. Sponsor
reserves the right to substitute a prize or prize component with one of equal
or greater value.
13. Selected entrants will be contacted by sms text message,
phone or email. A notification sms text message will be free of charge.
14. The determination of the winner by TMG will be final.
Entrants will have no right of appeal.
15. The winners of the competition are announced on the
website.
16. The selected entrants will be contacted within 28 days
of the closing date for the quiz. The prize will be awarded within 60 days of
the closing date for the Round. You can opt out of the Trivia Game Subscription
Service at any time. To do so, send a text message stating "stop" or
"game stop" to 84040 or call 1-866-670-0126 (24/7).
17. By entering this contest, each entrant expressly
consents to the Sponsor, its agents and/or representatives, storing, sharing
and using the personal information submitted with his/her entry only for the
purpose of administering the contest and in accordance with Sponsor's Privacy
Policy unless the entrant otherwise agrees.
18. If the Trivia Game Subscription Service is not capable
of running as planned due to any reason, including, but not limited to (the threat
of) fraud, a state of emergency, natural disaster, war, technical failures or
any other causes. TMG reserves the right to cancel, modify, terminate or
suspend the Trivia Game Subscription Service, without being liable for any
possible damage that occurs as a result thereof.
19. You release and agree to keep TMG indemnified from any
claim, cost, demand, tax, liability or damage suffered or incurred by TMG or
its directors, employees or agents, arising out of entry into Trivia Game
Subscription Service.
20. TMG is not responsible for any technical error that may
occur during the Trivia Game Subscription Service. This includes, but is not
limited to, any omission, interruption, deletion, defect or delay in operation
or transmission or failure of any telephone, mobile or satellite network.
21. TMG is not responsible for any lost, late or
incomprehensible entries in the quiz.
22. TMG may at any
time update, limit, extend or revise these Rules and Regulations. Therefore, it
is important and you agree to periodically check these Rules and Regulations.
23. Together with the other rules and regulation, sent by
sms and provided on this website, these Rules and Regulations constitute the
entire agreement between you and TMG.
24. This contest is subject to all applicable federal,
provincial and municipal laws. Void
where prohibited by law. The decisions
of the TMG with respect to all aspects of this contest are final and binding on
all entrants without right of appeal.
25. In the event of a dispute, sms text message entries will
be deemed to have been submitted by the authorized account holder of the
cellular telephone number used at the time of entry. "Authorized account holder" is defined as the
person who is assigned a telephone number by a telecommunications provider, or
other organization (e.g. business, educational institute, etc.) that is
responsible for assigning telephone numbers.
If the identity of an entrant is disputed, the authorized account holder
associated with the telephone number at the time of entry will be deemed to be
the entrant. A selected entrant may be
required to provide proof that he/she is the authorized account holder of the
telephone number associated with the selected entry. The sole determinant of the time for the
purposes of a valid entry in this contest will be the contest server
machine(s).
26. The Sponsor reserves the
right to modify, cancel or suspend this contest in the event of any accident,
printing, administrative, or other error of any kind without prior notice or
obligation. 27. TMG is not affiliated with, sponsored by or endorsed by any of the
listed products or retailers. Trademarks, service marks, logos,
(including, without limitation, the individual names of products and
retailers) are the property of their respective owners.
